In order to strengthen defense positions in cases involving so-called corruption crimes, it is necessary to understand that in this category of cases the main problems remain the practice of provoking crimes, as well as limited opportunities to verify the legality of the results of secret investigative and investigative actions.
Andriy Trigub, an associate partner of Skliarenko, Sydorenko and Partners, shared secrets of protection during the author's two-hour course "Protection Problems in Corruption Crimes" for Graduate School of Advocacy.
In particular, the speaker drew the attention of colleagues to the fact that the number of acquittals in cases of corruption crimes remains extremely low. So, in 2016-2017, no such verdict was made in the Dnieper, Svyatoshinsky, Solomensky, Obolonsky or Pechersky district courts of the city of Kyiv.
Speaking about the possible directions of building a legal position, A.Trigub elaborated on the typical "gaps" in the work of the prosecution. So, often the applicants in cases of alleged extortion of bribes are people who have previously played this role several times. Such persons (de facto provocateurs) are themselves under investigation in other cases, which may indicate their dependence on law enforcement officers. Also in the secret investigative (search) actions, the standard "disease" is the discrepancy between the transcripts of conversations in the protocols and the originals of the records.
To recall, the course “Problems of Protection in Corruption Crimes” is accredited by the National Association of Lawyers of Ukraine as an event to improve the skills of lawyers.
