Experts of "Skliarenko, Sydorenko and Partners" attorneys at law have provided the actual execution of the judgment by the Ministry of Education and Science of Ukraine. The department refused to issue a doctorate to a scientist who defended his thesis.

The associate partner of Skliarenko, Sydorenko and Partners Andriy Trigub formed the legal position in the case, and also represented the scientist in the courts and at the stage of execution of the decision of the Sixth Administrative Court of Appeal.

“It so happened that in Ukraine, in order to achieve justice, it is not enough to win a lawsuit. It happens that the losing side simply ignores the court decision that has entered into force, - A. Trigub commented on the case. - Therefore, in such important cases, lawyers are forced to seek and use all possible tools for the execution of the decision made in the name of Ukraine. Especially in cases where the losing party is a government agency. "

In the framework of this case, “Skliarenko, Sydorenko and Partners” in the interests of the client contacted the Department of enforcement of the decision of the Department of State executive service of the Ministry of Justice, as well as in Government Contact Center.

“The situation when the state agency is in no hurry to execute the court decision that has entered into force cannot be called normal,” said Oleksandr Skliarenko, managing partner of attorneys at law. - After all, unconditional respect for the decisions of the third branch of government (especially the other two) should be the basis of the rule of law. Otherwise, any ongoing judicial reforms have no practical meaning. ”

Recall that in 2014 the specialized scientific council of one of the capital's universities, according to the results of the public defense of the dissertation, awarded the scientist a doctorate. But the Ministry of Education and Science refused to issue a diploma. The point in the conflict, which lasted five years, was put by the Sixth Administrative Court of Appeal (judgment of 12.02.2019 in case No. 826/10702/18).
