On March 25, the Legal High School educational platform conducts regular classes of the School of Criminal Practice, which this time are devoted to the nuances of the tactics of protecting white collars. The topic of one of the lectures will be the protection of persons during the transfer of property to the management of the ARMA agency.

The organizers of the training invited the associate partner of Skliarenko, Sydorenko and Partners, attorney Andriy Trigub, to tell the lawyers about the problematic issues here.

The institution of management of seized property is aimed at preventing the possibility of loss of the property in relation to which there is reason to believe that it is evidence of a crime, or is subject to special confiscation. In this case, seizure can be imposed both on property under the jurisdiction of law enforcement agencies, and on property held by third parties.

On the basis of the relevant court decision, the Asset Recovery and Management Agency has a set of rights to organize the management of seized property, which during the seizure have legal priority over the rights of any third parties with respect to such property, including the rights of the owner.
